For the first time since the destruction of the second Bais Hamikdash, has Klal Yisroel seen so much confusion and bitterness within our community.  The actions of a lay leader attorney, Chaim Dovid Zweibel, Esq. and Rabbi Gottesman of the Agudah have made a mockery of the great Posek Hador Harav Elyashiv Shlita, no words can describe the rift that has developed within our holy community. The community is saddened by these events and incensed that Kavod Gedolim has become a mockery. Messrs. Zweibel and Gottesman have instructed Orthodox Jewish professionals not to report incidents of child sexual abuse, if perpetrated by Orthodox Jews, directly to law enforcement. This is blatantly against the law in the many states. This is a surprising challenge to a decision issued by universally respected preeminent Jewish law decisor, Rabbi Yosef Sholom Elyashiv, that directs Orthodox Jews all over the world to report incidents of sexual abuse directly to law enforcement (Click here to read a partial translation of Rabbi Elyashiv’s ruling).
  
If Zweibel and Gottesman think that their fabricated lies have any bearing on how we handle crimes against our children, they are terribly mistaken. We, as advocates, will fight them with our full strength and tenacity. We will prevail in keeping our children safe, we fear no one except our Holy G-d. We pray to HaShem that  Moshiach will come when our children and parents unite as one. How dare Zweibel question Harav Elyashiv and ask 14 times for a explanation of his Psak, Agudah has become a mouthpiece of venom and Sheker at the price of our young sweet Neshomas. 
       
The Voice of Justice believes that Agudath Israel’s policy of not reporting abuse to law enforcement is a violation of the law of many states and likely exposes those who report abuse to rabbis to charges of criminal obstruction of justice. At the very least, professionals who follow the erroneous and illegal directive of Agudath Israel’s leaders are subject to losing their license to practice, fines, and possibly face long prison terms.

Grand rabbi addresses religious dispute at New Square synagogue
    
(05/27/11) NEW SQAURE - The grand rabbi of a New Square synagogue spoke out today about an alleged arson attack that left a man critically burned.
Aron Rottenberg, 43, has severe burns over half his body following an attack several days ago. His family says the attack stems from the fact that he doesn't worship at the Hassidic community's main synagogue. Instead, they say he prays at the Friedwald Center for nursing and rehabilitation.
Grand Rabbi David Twersky said on a website that the incident brought a lot of tears and pain. He also said whoever needs healing, God should send them healing. In addition, the rabbi went on to state "it's against our ways" to hurt any Jews.
Charged in the attack is 18-year-old Shaul Spitzer. He is facing charges of attempted murder, arson and assault. Police are continuing to investigate and say there is no evidence that the grand rabbi is involved in the attack.
The Rottenberg family is now calling for a state and federal investigation into the case.

Rockland County, NY - Congressman Engel Condemns New Square Attack, As Feds Might Get Involved Police Say
Rockland County, NY - A lawyer for a man who was badly burned at his home in a Hasidic Jewish village is seeking a federal investigation into what he calls “hate crimes” by the community’s religious leadership.
He said the attack evoked “the Ku Klux Klan and Nazi Germany.”
Sussman’s letter dated this past Thursday to U.S. Attorney General Eric Holder, Gov. Andrew Cuomo and state Attorney General Eric Schneiderman said intolerance has long infected New Square.
Police said they would investigate thoroughly, but Sussman said local authorities do little because of the congregation’s political influence. New Square often delivers a bloc vote. For example, in the 2000 U.S. Senate race, Democratic contender Hillary Rodham Clinton took 1,400 of New Square’s 1,412 votes.

The New Square man who was severely burned in an arson attack last week had become an outcast in his Hasidic world for daring to go against the wishes of a figure who is not often defied.The "grand rebbe" of the Skver Hasidic sect that runs New Square is a 70-year-old, rarely seen, Romanian-born rabbi who comes from what's known as a "dynasty" of Hasidic leaders.
David Twersky is the rebbe, guru and monarch of the nearly 7,000 residents of New Square, making every significant decision about their way of life. Like other Hasidic leaders, he is believed by many to be an intermediary with God, so his word is not to be questioned.
"The rebbe never says things that are wrong for the people," resident Menasha Luftig, 33, said.

NEW SQUARE — Grand Rebbe David Twersky publicly denounced violence and said he's praying for Aron Rottenberg's recovery from Sunday's near-fatal arson attack in his community, but the victim's family on Friday rejected the overture and blamed the rabbi for inciting the attack by a teenage assistant who slept in his home.The family said in a statement that the Skver Hasidim's rabbi "gave the clear signals to continue with this terror against any non-believers of him. As this attacker came directly from his own inner circle, the rabbi's personal butler, who personally knows best of the rabbi's will and desires firsthand."

Rockland County, NY - For the first time since an 18 year old New Square man attempted to torch the house of a resident as a punishment for choosing to daven outside the village, The Skverer Rebbe, Rabbi David Twersky, has made a public statement regarding the attempted arson.
Rabbi Twersky’s remarks came late yesterday as he was addressing a group of bochurim who were making a siyum.
I ask each of you to daven for a complete and speedy recovery for the victim of this attack,” said Rabbi Twersky.  “Violence has never been our way.  The holiday of Shavuos is a time of healing and I hope that as the holiday approaches the people in our village will be like that of the Jews at the time of the giving of the Torah ‘as one person with one heart.’”
The Skver community is reeling following Sunday morning’s attack and Aron Rotenberg is hospitalized with third degree burns covering half of his body.
While the Skverer Beis Din has come out condemning the attack this is the first time that Rabbi Twersky himself has spoken publicly regarding the incident.

Friday, May 27, 2011:
This morning in Kings County Supreme Court, Criminal 320 Jay Street Part 20, Room 4.25, Meir Dascalowitz came late for his hearing, and his lawyer represented him in a brief hearing. Appearing for the twentieth time in Criminal Court before the Honorable Judge Miriam Cyrulnik, the court had in their possession the psychiatric report declaring Meir Dascelowitz unfit to proceed.  During the last hearing, the prosecutor informed the judge that two psychiatrists have evaluated the defendant, and declared him unfit to proceed but the report was not in possession of the court.
    
Today, the court received the report and the case was transferred to the Mental Health Part, before Judge Mathew J. D’emic for June 16, 2011.  On that date, the defendant will immediately remanded into a state mental facility, pretty much like a jail.  With bail no longer continued, Dascalowitz will remain in this mental facility until he is medicated and stabilized and declared fit to proceed in this case.  Click here for  technical explanation of how this works.
    

Noticeably absent from the last two hearings, was Ms. Henna White, Jewish community liaison to the District Attorney’s office. With growing resentment toward her involvement in pressuring the family to drop the charges, it is a great relief that she is no longer publicly showing an appearance in support of the case, from either side.
    

These proceedings are temporarily on hold until the defendant will be fit to proceed, the family of the victim continues to be harassed by the community, despite a continued order of protection.  The recent developments in the New Square violence against another fellow Jew, helps shed some light on these shunning practices that have previously been hidden  from the outside world. Within insular communities of the ultra orthodox,  Jewish zealots will go to extreme measures to enforce control. Whether they are acting to preserve their Rabbi’s teachings and rulings, or merely their own self made rules, a community resident must comply in full.
    

The current controversy in ultra Orthodox communities revolve around a Jew reporting another Jew, on matters of sexual crimes. While a prominent Rabbi has issued a ruling allowing these types of reports, other Rabbis have been very vocal about issuing rulings against reporting sexual crimes. The controversy continues with the help of Ohel, the largest social services agency, who is currently under investigation for not reporting sexual crimes.
    

Social isolation, intimidation, outright harassment, and now, even violence, has become an all too common occurrences. In Williamsburg, where the Dascalowtiz victim has lived his whole life, these practices have taken its toll on the victim and his family. Phone calls to the family’s home answering machine with cursing and threatening messages, were just the beginning. Then, the  young children of the family were terrorized in school. The yeshiva threatened to throw them out, claiming that they are evil people who reported another fellow Jew.
    

And then, they did throw out the victim from Yeshiva. Intending to intimidate the family even more, the Yeshiva then called in ACS-Child protective Services, to “investigate” educational neglect of the child. Back in March, the family participated in the preparations for the Voice of Justice Freedom Seder for Survivors of Abuse.  In between peeling potatoes and preparing horseradish for the gefilte fish, the volunteers learned about Leibowitz’s release after the Kellner arrest.  Immediately after the news spread in the community, there was singing and dancing in the streets, an indication that Chassidim will rejoice every time another fellow Jew is out of jail.  Then, the family got a terrible phone call from the paternal grandparents. They had received a threatening phone call, saying, “Baruch Mordechai is out, and your son should watch out”. This was a direct message that the scare tactics will intensify until the family flees the country and drops the charges.
    

In the orthodox world, it is the victims who are continuously victimized, until they are intimidated to drop the charges. If all else fails, and the victim is brave enough to continue, the case will be tampered with until the prosecution will no longer stand.  This has happened to the Rottenbergs in New Square, as they continued to fear for their safety yet their please were ignored by law enforcement. This too, is happening to the victims of all the high profile sexual crimes cases in the Jewish community. The Dascalowitz victim’s family has repeatedly feared for their safety and called the police many times.  It will take enormous cooperation from supporters to keep this family alive, and strong, to continue this case to completion.

NEW SQUARE — Relatives of a man who was severely burned in an arson attack were shouted down by a resident of this Hasidic enclave Wednesday for going against the will of the community's grand rebbe.
A lawyer for Aron Rottenberg, the 43-year-old plumber who suffered burns on half his body Sunday, held a news conference in front of the Rottenberg home to call for state and federal investigations into the arson attack.
Lawyer Michael Sussman, joined by Rottenberg's son and son-in-law, said that Rottenberg was harassed for months by the Skver Hasidic sect that runs New Square because he would not pray at the main synagogue, as required by Grand Rebbe David Twersky.

"This is nothing other than religious bigotry," Sussman said. "If it doesn't stop, it will get worse."
Early in the news conference, a six-year New Square resident, Shulem Sofer, began screaming that Sussman was lying. He yelled out that Rottenberg broke the community's rules and that it was justifiable to try to burn down Rottenberg's home, but not to injure the man.
"The rabbi never said to do fire to people," Sofer screamed in a high-pitched voice. "It's anti-Semitism. It's anti-New Square."
Sussman countered that people in the United States are free to pray where they want, but Sofer said he followed the grand rebbe's rules.
"I am from Jew land," he said, drawing laughter from the crowd.
Rottenberg's son-in-law, Moshed Elbaum, asked Sofer what his father-in-law had done wrong. Sofer replied, "It's the wrong thing to go against the rabbi."
As close to 50 people watched, mostly men in wide-rimmed black hats, Sussman and Rottenberg's relatives retreated onto the lawn of the home, and police used tape to separate them from Sofer.
Shaul Spitzer, 18, who formerly worked in Twersky's home and is the cousin of the village's deputy mayor, has been charged with first-degree attempted arson, second-degree attempted murder and first-degree assault in the attack on Rottenberg.
After Wednesday's news conference, the men on the street sharply disagreed about who was at fault, Rottenberg for not following the grand rebbe's rules or Twersky for not speaking out against violence before the attack.
Menasha Luftig, 33, said that Rottenberg knowingly angered the community.
"He abused us more than was done to him," Luftig said. "We told him a few times not to go against the rebbe. Mr. Rottenberg was ready to fight. There is a saying in the Bible, 'Watch out when you play around with your spiritual leaders. You can get burned.' "
Ezrel Zarkowsky, 25, said he received great support from Twersky and the community when his 2-year-old daughter was killed in a traffic accident before Passover.
"This is not just a village; it's a family," he said. "Mr. Rottenberg came, and his whole goal was to split this family."
But Pinches Dirnfeld, 26, who attends Columbia University, blamed Twersky for letting the violence get out of control and said he looked forward to leaving New Square.
"This kid couldn't have the means nor the courage to do this all by himself," Dirnfeld said. "He must have had help. I don't think the rebbe determined what happened. But he knew there were terror attacks carried out in his name and did nothing about it, so I hold him responsible."



A note posted in Hebrew at the main synagogue Wednesday condemned violence of any kind."Much effort was made to settle the matter amicably and peacefully, and there is no justification why private people should take such an action," it said.
On Tuesday, Twersky was visited in New Square by Rabbi Meir Lau, a former chief rabbi of Israel and current chief rabbi of Tel Aviv, according to the blog FailedMessiah, which reports on Hasidic communities. The blog showed pictures of Twersky and Lau talking and laughing over a plate of fruit.
Rottenberg's wife, Ruth Rottenberg, told reporters in her home Wednesday that the family had been harassed since her husband started attending prayers at a nearby nursing facility around the High Holidays in the fall. She said he believed prayers were too long in the main synagogue.
Their 15-year-old daughter was soon kicked out of school, she said, and their home and car windows were smashed. A week before the attack, an anonymous phone caller said their house "won't be worth a penny," she said.
Calls to the police went nowhere.
"It sounded like this was acceptable, to police, to everyone," she said.
Her husband had more than eight hours of surgery, including skin grafts, Tuesday at Westchester Medical Center in Valhalla. He has third-degree burns on half his body.
Aron Rottenberg encountered Spitzer with flammable liquid outside the family home early Sunday, police said. They struggled, and both were burned.
Spitzer, who was released from custody Tuesday on $300,000 bail, is in the Cornell Medical Center burn unit in Manhattan for severe burns on his hands and arms.
Sussman called for state and federal investigations. He said that "cowardice" characterized Rockland and state politicians who are too indebted to the Hasidic voting bloc to push for justice.
New Square, an enclave deliberately cut off from the outside world, is home to the fast-growing Skver Hasidic sect. The village's population increased by 50 percent to 6,944 between 2000 and 2010.
Twersky became grand rebbe in 1968, succeeding his father, Rabbi Yakov Yosef Twersky, who had established New Square with a small group of followers in 1954. The Skver Hasidic sect dates to the late 1700s in the City of Skver in modern-day Ukraine.

NEW SQUARE — A press conference held today by family members of a man badly burned in an arson attack turned into a shouting match when a village man called the family's lawyer an anti-Semite for going against the grand rabbi.
At the press conference held in front of Aron Rottenberg's Truman Avenue home, attorney Michael Sussman said the 43-year-old plumber was targeted with protests by the village Hasidic Jewish community's leadership for not praying in grand rabbi David Twersky's synagogue . Sussman called for state and federal investigations into the arson attack Sunday that left Rottenberg severly burned.
Rottenberg's son Jacob, 21, said he had spent the evening of the attack nervously watching the security camera he had installed a week earlier after threatening phone calls.
Jacob Rottenberg said the suspect, Shaul Spitzer, 18, of Adams Lane, had approached the home wearing a scarf over his face. The two men were injured when Rottenberg tried to remove the scarf.
Aron Rottenberg's son-in-law, Moshe Elbaum, was interrupted several times at the press conference by village resident Shulem Sofer.


   
Sofer refuted the family's claims and during a heated exchange said Sussman was "anti-semitic ." When Elbaum asked what his father-in-law had done wrong, Shulem replied: "It's the wrong thing to do against the rabbi."
Aron Rottenberg suffered third-degree burns across 50 percent of his body during Sunday's attack. He underwent skin grafts Tuesday at the Westchester Medical Center.
Ramapo police charged Spitzer with felony counts second-degree attempted murder, first-degree attempted arson and first-degree assault.
Spitzer, who worked in the grand rabbi's house and is a cousin of the village deputy mayor, was released Tuesday evening from custody after his family and community members posted $300,000 bail.
They posted cash and a bank check with the court, District Attorney Thomas Zugibe said today. Zugibe said the case will be brought before the grand jury.
He remains in the Cornell Medical Center burn unit in Manhattan for severe burns on his hands and arms he suffered during the attack.

NEW SQUARE — An attorney hired by the family of a man severely burned during an alleged arson attack early Sunday said he will ask for a federal investigation as he reiterated the family's accusation that the incident had resulted from intimidation by religious leaders of the Hasidic Jewish village.
Aron Rottenberg's family hired Orange County lawyer Michael Sussman to ensure the investigation stays on track and the family's interests are protected.
Sussman, known for his civil rights advocacy, is holding a news conference today at Rottenberg's 29 Truman Ave. home, where the attack occurred.
"We know the history, and they (New Square leaders) always find a way to make things go away," said Moshe Elbaum, Rottenberg's son-in-law. "Even though the detectives are now involved, we want to make sure things go right."
Rottenberg, 43, suffered third-degree burns across 50 percent of his body during a confrontation after 4 a.m. Sunday with Shaul Spitzer, 18, of 7 Adams Lane, Ramapo police said.
Rottenberg, his wife and three children were at home. He and his son Jacob confronted Spitzer and flames from an incendiary device burned all three men.
Rottenberg, a plumber, said his decision not to pray in Grand Rabbi David Twersky's synagogue on Truman Avenue led to months of protests outside his house. Last fall's protests had dissipated until Sunday.
On Tuesday, Rottenberg underwent hours of skin graft surgery at the Westchester Medical Center in Valhalla, Elbaum said.
Spitzer was ordered held on $300,000 bail during his arraignment at Cornell Medical Center's burn unit in Manhattan, where he's being treated for burns to his arms and hands. Late Tuesday afternoon, he posted bail, Sheriff's Department Chief Louis Falco said. Spitzer also had to surrender his passport.
He remains hospitalized, but because he posted bail, the Sheriff's Department will not have to deploy its plan to have the six corrections officers guard him 24 hours a day — two per shift in three shifts — at a cost estimated at $4,000 per day, Falco said.
Spitzer works as a butler in Twersky's house and is a cousin of Deputy Mayor Israel Spitzer, said Elbaum and several other residents.
Police charged Spitzer with second-degree attempted murder, first-degree attempted arson and first-degree assault. His lawyer, county public defender James Licata, didn't return a call seeking comment.
Very few New Square residents will talk about the incident or Twersky's decree that all of his followers pray at the village's synagogue.
"The old rabbi made these rules," Zalmen Rosen, who works at the New Square Fish Market on Adams Lane, said Tuesday. "If you don't like it, move out of here. What, do you want to fight with these people? If you live here, you have to pray here."
Rosen is friends with Rottenberg and said the Spitzers are popular in the village. He said the suspect is a cousin of the deputy mayor.
Rosen said the violence is wrong and that Twersky's religious court — called a Beth Din — should have handled the dispute. He said some young hotheads looking to support Twersky went at the Rottenbergs and that he doesn't believe Spitzer purposely hurt Rottenberg.
Rottenberg told The Journal News in November that he felt his family was being terrorized by supporters of the grand rabbi. He and nearly two dozen other residents boycotted the rabbi's synagogue over the tight control that leaders hold over the community. They instead walked nearly a mile to Friedwald Center to pray.
Hank Sheinkopf, a renowned Democratic consultant, released a statement late Tuesday on behalf of a "group of New Square residents." He would not specify who retained him, but contacted a Journal News reporter by cell phone after the reporter provided his number to a New Square man who said he and other residents would have someone call on their behalf.
"No words can express the sadness we feel over the recent events," the statement reads. "Such behavior has never been tolerated and will never be tolerated. We pray for the healing of those injured, and our communal hearts stay with their families at this very difficult time.
"In our school systems, we intend to renew our commitment to reinforcing our well known ethos of Shalom, peace, and love," the statement continues. "Our pain knows no end." The statement adds that New Square, historically, has been a "place of peace, charity and kindness throughout the world" and that for more than 60 years, "we have spent our time creating a community that fosters harmonious relationships between residents."
Responding to Sheinkopf's statement, Sussman said: “Equating the two people in the statement ... is an outrage and an insult to my client,” Sussman said. “He is severely burned not through his own acts, but because of the act of the assailant and those who sponsored him.”
Shaul Spitzer is accused of trying to kill Rottenberg after throwing gasoline-soaked rags onto the rear deck of Rottenberg's house.
Sussman said Rottenberg had no personal issues with Shaul Spitzer, contradicting what Ramapo Supervisor Christopher St. Lawrence said on Monday that he'd been told by Israel Spitzer. St. Lawrence called the attack "horrific."
Sussman said Rottenberg's rights to practice his religion had been violated and that the possibility of federal conspiracy charges existed.
"Rather, this event culminated months of increasingly violent and coordinated religiously biased attacks on Mr. Rottenberg triggered by the victim's choice of synagogue and religious leader," Sussman said.
Elbaum said that if Ramapo police and the town had acted more aggressively last fall with New Square, his father-in-law might not be hospitalized.
"What we want first is everything should be all right with my father-in-law," he said. "We want to know who was behind this and for it to stop."
